Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the website, services, and systems provided by The Growth Protocol — powered by LeadNextAI ("we," "us," "our"). By booking a call, signing up for a service, or otherwise using our systems, you agree to be bound by these Terms. If you do not agree, do not use our services.

Who We Serve

Our services are built for home improvement and local service businesses, including but not limited to landscapers, kitchen & bath remodelers, pool builders, plumbers, electricians, pest control companies, tree services, roofers, HVAC companies, and solar installers. Our services are intended for businesses and individuals aged 18 and older.

Services Provided

We design, build, and manage automation systems that may include: AI follow-up systems, review and reputation automation, referral and growth engines, database reactivation campaigns, 24/7 AI employee (voice and chat) systems, CRM and messaging automation, and support for advertising campaigns. The exact scope of services is defined in your individual proposal, invoice, or agreement with us.

No Guarantee of Results

While our systems are designed to help you capture more leads, bookings, and reviews, we do not guarantee any specific outcome, revenue figure, booking volume, or review count. Results vary based on your market, pricing, team, offer, budget, and other factors outside our control.

Payments, Fees & Subscriptions

Fees for our services are due in advance unless otherwise agreed in writing. Subscription-based services renew automatically at the end of each billing cycle unless cancelled in accordance with your agreement. A failed or declined payment may result in your account or systems being paused until payment is resolved.

Refund Policy

All sales are final unless a refund is explicitly offered in writing as part of your specific agreement (for example, a conditional guarantee tied to a named offer). Where no such written refund term exists, no refund will be issued.

Intellectual Property

All systems, scripts, workflows, templates, automations, and other materials we build are our intellectual property. You may not copy, resell, reverse-engineer, or white-label our systems or materials without our prior written consent.

Client Responsibilities

You are responsible for providing accurate business information, timely access to the accounts and tools we need to do our work, and reasonable cooperation during onboarding and ongoing delivery. Delays caused by missing information or access may delay your results.

Limitation of Liability

To the maximum extent permitted by law, The Growth Protocol and LeadNextAI will not be liable for any indirect, incidental, special, or consequential damages, including lost profits or lost business, arising from your use of our services.

Third-Party Software

Our systems rely on third-party platforms such as Twilio, Meta, Google, Stripe, and various CRM tools. We are not responsible for outages, policy changes, account suspensions, or bans issued by these third-party platforms.

Confidentiality

Each party agrees to keep confidential any non-public business, technical, or client information shared during the course of the engagement, and to use it only for the purposes of delivering or receiving the services.

Termination

Either party may terminate services in accordance with the terms of your specific agreement. Upon termination, outstanding fees remain due, and access to systems built on our infrastructure may be suspended.

Governing Law

These Terms are governed by the laws of Canada, without regard to conflict-of-law principles.

Binding Arbitration

Any dispute arising from these Terms or our services will be resolved through binding arbitration rather than in court, except where prohibited by law.

Class Action Waiver

You agree that any dispute will be brought on an individual basis only, and not as part of a class, collective, or representative action.

Website & System Availability

We aim to keep our website and systems available and running smoothly but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages, or unforeseen issues may temporarily affect availability.

Changes to Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of our services after an update constitutes acceptance of the revised Terms.
